Please read these Terms of Use carefully before using our website. By accessing or using this website and placing orders, you are deemed to have read, understood, and agreed to be bound by these Terms in their entirety.

1. Parties and Definitions

This website and all pages linked to it (the "Site") are owned and operated by STARTUP CREATIVE TEKNOLOJİ VE DANIŞMANLIK LİMİTED ŞİRKETİ, trading under the brand name My Tiny Garden, with its registered address at Eğitim Mah. Poyraz Sok. No:1/68, Kadıköy, Istanbul, Turkey (the "Company").

Any individual or entity accessing, browsing, or transacting on this Site is referred to as the "User". By continuing to use this Site, the User represents and warrants that they are at least 18 years of age, have the legal capacity to enter into binding agreements under applicable law, and accept all terms and conditions set out herein.

The following key terms apply throughout these Terms of Use:

  • "Site" — the website operated by the Company at its web address and all associated pages.
  • "Services" — all content, features, products, and purchasing facilities made available through the Site.
  • "Account" — the registered user profile created by a User on the Site.
  • "Order" — a purchase request submitted by a User through the Site.

2. Scope of the Site and Services Offered

My Tiny Garden is an online retail platform based in Turkey that ships plant and vegetable growing kits and related gardening products globally, including to the European Union, the United Kingdom, the Gulf region, and the United States.

The Company reserves the right to modify, suspend, or discontinue any part of the Site or its Services at any time, including altering product ranges and prices, without prior notice except where required by applicable law. Such changes will not affect Orders already confirmed by the Company.

The Site includes complimentary gift wrapping and a personalised message card with every order, at no additional charge to the User.

3. Account Registration and User Obligations

To access certain features of the Site, Users may be required to create an Account. By registering, the User agrees to:

  • Provide accurate, complete, and current registration information, including full name, address, and contact details.
  • Maintain the confidentiality of their account credentials (username and password) and take all reasonable steps to prevent unauthorised access.
  • Notify the Company immediately at info@mytinygarden.com.tr if they suspect any unauthorised use of their Account.
  • Accept full responsibility for all activities conducted through their Account.

The Company shall not be liable for any loss or damage arising from a User's failure to safeguard their account credentials.

The Company reserves the right to suspend or permanently close any Account that is found to be in breach of these Terms, used fraudulently, or otherwise detrimental to other users or the Company, and to initiate legal proceedings where appropriate.

4. Intellectual Property Rights

All intellectual property rights in and to the Site — including but not limited to its design, text, graphics, logos, images, software, database structures, and product descriptions — are the exclusive property of the Company and are protected under national and international intellectual property laws, including applicable EU copyright and trade mark regulations.

Visiting the Site does not grant the User any licence or right to use, reproduce, copy, distribute, transmit, publish, or otherwise exploit any content from the Site without the prior written consent of the Company. Unauthorised use of any content may give rise to a claim for damages and/or constitute a criminal offence.

The My Tiny Garden brand, trade name, and associated marks are the proprietary assets of the Company. All third-party trade marks referenced on the Site remain the property of their respective owners.

5. Acceptable Use and Prohibited Conduct

The User agrees to use the Site solely for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Site. Without limitation, the User must not:

  • Use the Site in any way that violates applicable local, national, or international laws or regulations.
  • Engage in reverse engineering, decompiling, disassembling, or any other attempt to derive the source code or underlying algorithms of the Site or its software.
  • Transmit any unsolicited or unauthorised advertising or promotional material (spam).
  • Upload or distribute viruses, malware, or any other harmful code.
  • Attempt to gain unauthorised access to any part of the Site, server, or database connected to the Site.
  • Use the Site in any manner that could damage, disable, overburden, or impair it.
  • Act in a manner contrary to public order, good morals, or decency.

The User is solely responsible for any interaction with third parties through or in connection with the Site. The Company is not a party to and accepts no responsibility for such interactions.

Any User found to be in breach of these acceptable use requirements will be liable for all resulting loss or damage. The Company reserves the right to suspend or terminate the User's access without notice and to report conduct to the relevant authorities where required.

6. Orders, Pricing, and Payment

All prices displayed on the Site are shown in the applicable display currency and are inclusive of any applicable taxes. Shipping costs and the threshold for free shipping are calculated dynamically and displayed clearly at checkout before the User finalises their Order. The Company does not publish fixed shipping rates within these Terms, as these are determined at the time of purchase.

An Order placed by the User constitutes an offer to purchase. The Company reserves the right to accept or decline any Order. A binding contract is formed only upon the Company's dispatch confirmation communicated to the User by email.

All payments are processed through a secure payment gateway. The Company does not store full card details on its own systems. By placing an Order, the User confirms that the payment method used is their own or that they are duly authorised to use it.

The Company reserves the right to correct any pricing errors on the Site. If an Order has been placed on the basis of an incorrect price, the Company will notify the User and offer them the option to proceed at the correct price or cancel the Order with a full refund.

7. Returns, Cancellations, and Right of Withdrawal

In line with international consumer protection standards and the Company's own policy, Users have the right to withdraw from a purchase and return any eligible product within 14 days of receipt, provided the product is unopened and unused and in its original packaging.

To exercise this right, the User must notify the Company at info@mytinygarden.com.tr within the 14-day period. The Company will provide return instructions upon receipt of such notification.

Products that have been opened, used, or are not in their original condition may not be eligible for return, subject to any mandatory rights the User may hold under applicable law in their country of residence.

Refunds, where applicable, will be processed to the original payment method within a reasonable time after the returned goods are received and inspected by the Company.

8. Limitation of Liability

The Company provides the Site and its Services on an "as available" basis. To the fullest extent permitted by applicable law, the Company excludes all representations, warranties, and conditions — whether express or implied — relating to the Site and the information and materials published on it.

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of, or inability to use, the Site or its Services. This includes, without limitation, loss of profits, loss of data, or business interruption.

Nothing in these Terms shall exclude or limit the Company's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

The Company commits to ensuring Users can access and benefit from the Services except in the event of technical failures or circumstances beyond its reasonable control.

9. Privacy and Personal Data

The Company processes Users' personal data (including name, address, email address, and telephone number) in accordance with its Privacy Policy, which is published separately on the Site and forms an integral part of the overall legal framework governing use of the Site.

For Users accessing the Site from the European Union or the United Kingdom, personal data is processed in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and, where applicable, the UK GDPR. Users have the right to access, rectify, erase, restrict processing of, and port their personal data, as well as the right to object to certain types of processing.

The Company will not sell or share personal data with unrelated third parties for their own marketing purposes without the User's explicit consent. The Company may share data with affiliated entities for promotional and marketing purposes as set out in the Privacy Policy. Personal data may be disclosed to competent authorities where required by law.

10. Amendments to These Terms

The Company reserves the right to update or amend these Terms of Use at any time. Any changes will be effective immediately upon publication on the Site. The date of the most recent revision will be indicated at the top or bottom of these Terms.

Users are encouraged to review these Terms periodically. Continued use of the Site following the posting of any amendments constitutes acceptance of those changes. Where required by applicable law, the Company will provide advance notice of material changes.

11. Force Majeure

Neither party shall be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of the affected party. Force majeure events include, but are not limited to, natural disasters, earthquakes, floods, fire, acts of war, armed conflict, terrorism, strikes or industrial action, epidemics or pandemics, government or regulatory actions, and significant disruptions to telecommunications or internet infrastructure.

In the event of a force majeure occurrence, the obligations of the affected party are suspended for the duration of the event. The affected party shall notify the other party as soon as reasonably practicable.

12. Severability and Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between the Company and the User in relation to the use of the Site and supersede all prior communications or agreements on the same subject matter.

13. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Turkey, without prejudice to any mandatory consumer protection rights that Users resident in their respective countries may hold under the laws of their jurisdiction (including EU consumer rights directives applicable to EU-resident users and the Consumer Rights Act 2015 for UK-resident users).

In the event of a dispute arising out of or in connection with these Terms or the use of the Site, the parties shall first seek to resolve the matter amicably through good-faith negotiation. Users who are consumers resident in the European Union also have the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Where amicable resolution is not achieved, disputes shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul, Turkey, subject to any overriding mandatory law applicable in the User's country of residence.

For evidentiary purposes, the Company's books, records, and electronic system logs shall constitute valid evidence in any legal proceedings arising between the parties.

14. Notices and Contact

All notices and communications from the Company to the User will be sent to the email address provided during registration or at checkout. The User is responsible for keeping their contact information up to date.
